The largest bank in the United States, JPMorgan Chase & Co., is accusing young Jewish entrepreneur Charlie Javis of defrauding millions of potential customers into buying his company for $175 million.
In a lawsuit filed by the bank last month, it accused the once-promising CEO on Forbes’ 30 Under 30 list of inflating the client list of his college financial planning startup, Frank, which was acquired by JPMorgan in September. had bought. 2021.
The bank accused Olivier Amar, former chief development and acquisitions officer at Javis & Frank, of defrauding nearly four million customers and creating millions of fake profiles on the platform, hiring a data science professional to hide his actions.
“To cash in, Javis decided to lie, including lies about Frank’s success, Frank’s size, and the depth of Frank’s market penetration,” the suit read.
In turn, Javis’s attorneys have denied the allegations against their client and have filed a lawsuit against JPMorgan for allegedly trying to avoid paying him.

The now 30-year-old founded Frank in 2016, when she was just 24. With a stated goal of helping college students fill out financial aid forms and save billions of dollars in tuition, Frank and its young founder captured the world’s attention.
But according to JPMorgan, it was mostly a hoax, or at least an exaggerated success story. The bank that Frank claimed to have 4.25 million college students as customers by the end of 2021 instead never had more than 250,000.
According to a New York Times report, despite repeated warning signs, Javis continued to enjoy sympathetic coverage from major news outlets including Forbes, Fast Company Magazine, Medium, and Insider.

It was noticed by the US Department of Education soon after Frank was founded. In its early days, the company offered financial assistance to college students for their tuition on a website called frankfafsa.com.
FAFSA stands for Free Application for Federal Student Aid and is a registered trademark that was used by Frank without permission, the department said at the time. As part of a settlement agreement reached in 2018, Frank handed over the web address to the department and switched to an alternate web address.
Around the same time, Adi Omesi, an Israeli co-founder of Frank, sued Javis for wage theft in Israel and received compensation.
But this did not stop his overwhelmingly positive media coverage.
In 2018, Business Insider ran an article titled: “A 26-year-old founder has a solution to what Bill Gates calls an ‘unnecessary roadblock’ in college – and his startup is helping students get around thousands of tuition fees.”
In the article, Javis claimed that Frank saved its users an average of $28,000 on tuition.
However, in an article published by the outlet after JPMorgan’s lawsuit against Javis, it cited student-aid expert Mark Kantrowitz as saying that Frank was simply simplifying the process for students to fill out the FAFSA form.
Kantrowitz told Insider, “Frank did nothing that would have affected the amount of aid the students would have received if they had filed the FAFSA.” “This does not double the amount of financial aid.”
He added that Frank was making up figures “at random” when describing the amount of help his users had received.
Joyce’s close relationship with the media began in 2011, when she appeared on Fast Company’s 100 Most Creative People of 2011 list for her role in an earlier startup she founded called PowerUp.
Founded as a non-profit, PowerUp’s stated goal was to provide loans to entrepreneurs in poor countries and help lift them out of poverty using small contributions made by college students.
But an internal investigation found no evidence that PowerUp was registered as a nonprofit. The outlet cited a former board member of the company as saying it never gained much traction, contradicting Joyce, which said in 2013 that the company had raised $300,000 in debt.
Javis soon abandoned the idea and went on to found Tapd, a company that sought to connect young professionals to job opportunities via text messages.
The company was later rebranded as Frank’s after financial difficulties, which at one point forced Javis to fire his entire team. Still, Javis characterized the challenges as a teaching moment and framed it as part of his eventual success story.
In an email addressed to an online magazine in 2020 and obtained by Insider, Frank’s public relations representative described Frank’s story as “miraculous” and said that Javis’s “first company failed after 18 months” and that he is still “persuading I succeeded. [investors] to fund his next company, Frank.

Netflix report earnings this week with tepid results.

Critics are calling the streaming service “topped out”, despite its hock stick performance over the past 5 years. To me it sounds like a sour grapes spin from old school broadcast losers who are scrambling to find their own steaming solutions.

The old boy theory from Nielsen is that too many choices can overwhelm consumers and create the unpleasant feelings. In behavioral psychology we call that “decision fatigue” and can sometimes lead to shut down and impede purchase potential.

 

The question to ask is what demographic chooses old broadcast television when there’s too much video streaming content! If that was a valid business argument other streaming competitors like Hulu, Disney (DIS), CBS (CBS) and Amazon wouldn’t be working so hard to displace Netflix.

A Broken Neck and Lost Money Didn’t Stop Him 

 

In this chapter, two friends who had not seen each other in years joined a wildlife rescue team to determine security of bald eagle fledglings in a vast natural recreation area. After the work was complete they went camping as a reward. What happened that evening in the rugged wilderness taught as much about nature, as it did about strength, precision and determination, in a man named Peter Churchfield. Who made a fortune while all those around him were losing theirs.  Continuing the conversation from last time…

 

I walked over to the cooler and pulled out three beers, twisted the tops, and put one in each of their outstretched hands.

“By age twelve, I had learned that buying my own clothes gave me freedom,” Peter told Bernie. “I used my allowance to buy shoes and a Milwaukee Brewers cap, and I was happy to save up to buy them!”

 

Bernie took a long sip of his cold beer. “A supportive family makes a difference, I guess. I understand how learning good communication and thinking skills saved your fortune, but please, continue explaining your secrets to success.”

 

“Perhaps it started when I took on the responsibility for my dad’s car,” Peter said. “He let me use the car on the weekends. After I brought it home, I washed it and I cleaned the garage to make sure I’d be allowed to borrow it again.”

 

“Fine. I guess you had to start somewhere,” Bernie said, his tone indicating that he felt cheated by the answer.

 

“Oh, there’s more to him than that,” I said. “Tell him about those college days, Peter.”

 

“Well, I was lucky enough to get an athletic scholarship, but it ended when I broke my neck. I was pole vaulting.” He gave Bernie a matter-of-fact look and flashed that Peter smile of resignation. “At that time, it was just the way it was. I could no longer compete, so my scholarship was taken away. No lawyers, no lawsuits. I just lost my scholarship funding.”

 

“That would be an outrage by today’s college standards,” Bernie exclaimed.

 

“You’re right. Today, students wouldn’t lose their scholarships. I did, but it didn’t bother me. I didn’t go to an attorney. I just found a way to stay in school and went on.”

 

Because I was proud of his story, I chimed in on behalf of my friend. “Peter developed the moral code that challenges were meant to be overcome without blame or excuses. Why would he stop his life over a broken neck and lost money?” I said with cynical fervor. “After spending seven weeks in the hospital, he gathered himself, neck brace and all, and transferred to a different college. He paid for it on his own, but it proved to be more than he could manage. Strapped with bills and wanting desperately to stay in school, he did the unthinkable: he began practicing to compete for another athletic scholarship. In what today would probably raise legal red flags and cause a public-relations firestorm, he earned a second athletic scholarship.”

While working on my second book, a baffling societal oddity appeared—people who believe economic dignity is provided by a particular political party. The viewpoint offended my sense of inalienable power all humans possess. Financial Freedom has little to do with a president or party in power. Economic cycles, perhaps, can come to bear, but politicians regardless of what they campaign, do not. In capitalistic societies fortunes have always been made regardless of governments.

Believing one’s preferred brand of politics makes you rich, ridicules the essence of the American Dream. Yes, people feel safer in groups but expecting entitlement for such, is absurd. Mocking a current administration because it didn’t fit their self-serving beliefs seemed even more parochial then the conservatives they criticized.

Still, taking no stock in either side, I was troubled they were without an alternative path to prosperity. Then over scotch and cigars with men friends, who at some point in life, pushed an envelope to its limits. One repudiated when hearing people would pull a religion or race card rather than apply the gift of free enterprise.

“Until you land 39 thousand pounds of fully loaded thrust onto a moving aircraft carrier in the Persian Gulf. Where your one wrong move can kill hundreds of people on board. You don’t truly understand responsibly of individual freedom!”

His words echoed. The next day when we spoke again, he gave me the number of his ex-wife, who once was a friend of mine. “Call her and she’ll set you straight.” He assured me.

Theirs’s was a relationship of passion with political difference, destined to fail. She was of Arab decent now living in Lebanon but educated in New York City. My recollection of her was a liberal yet pragmatic thinker and anticipated our conversation would lead to even more confusion about my dilemma—but I rang her anyway.

“Unlike Mexico, Europe and Canada.” She schooled me. “Today’s immigrants from further places are exposed to America in manic ways and expect freedom is simply the anthesis of the former regime. They may unknowingly carry shock effects of oppression. And might expect not to do much besides live there, to reap benefits. Not all that odd.”

I hadn’t thought about it in such clinical terms and it explained how someone could blatantly trash the country they live in because the party they favored was not in power. And at the same time, excepted financial benefits that 200 plus years of capitalism produced.

She not only turned on the light but agreed to explore with me understandings that might better plot paths to dissuade expectations of merely walking in and hoping the party that hands out the most will be elected. Now, with this expanded effort and if sleeves are rolled up, greater numbers of diverse people can achieve their American Dream.

Someday in a hoped-for future, by truly equalizing wealth injustices and improving the human condition. We might live without political vilification or a vast divide when it comes to those who have and have not.

Cloaking extremism in sanctity of liberal purpose is equally hypocritical.
